Terms of Service

Welcome to BarsVision. These Terms of Service ("Terms") govern your access to and use of the BarsVision platform, website, and services (collectively, the "Service") operated by BarsVision ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

BarsVision is an AI-powered platform that transforms audio files into beat-synchronized animated MP4 videos with visual scenes. The Service uses artificial intelligence for animation planning and frame generation.

2. Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns related to payment processing.

When you make a purchase, you are buying from Paddle, who then grants you a license to use the Service. All payment processing, invoicing, and sales tax collection is handled by Paddle. By purchasing, you also agree to Paddle's Checkout Buyer Terms and Privacy Policy.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Pricing and Payments

4.1 Billing

The Service operates on a pay-per-use model. You are charged based on actual usage — either per second of output video for narrative videos or per generation for general MVs. There are no recurring subscriptions.

4.2 Price Changes

We may change pricing from time to time. Price changes will be communicated through the Service or via email. Your continued use of the Service after a price change constitutes your agreement to the new pricing.

4.3 Taxes

All applicable taxes are calculated and collected by Paddle based on your location. Prices displayed may or may not include tax depending on your jurisdiction.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe upon the intellectual property rights of others
  • Upload content that is unlawful, harmful, or objectionable
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for any fraudulent or deceptive purpose
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Generate content that depicts child exploitation, non-consensual intimate imagery, or promotes violence

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, and underlying technology, is owned by BarsVision and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.

6.2 Your Content

You retain ownership of all audio files and other content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.

6.3 Generated Output

Subject to your compliance with these Terms and applicable law, you own the video output generated by the Service from Your Content. You are responsible for ensuring that your use of the generated output does not infringe third-party rights.

7. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times. The Service may be subject to interruptions due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BarsVision and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, or be error-free.

10. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data after a reasonable retention period
  • Sections that by their nature should survive will remain in effect (including Limitation of Liability, Intellectual Property, and Governing Law)

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, providing additional notice (such as via email or an in-product notification). Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BarsVision is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
